These terms govern services provided by Apolo Agency to its clients. They apply from the moment a client grants access to their advertising assets or accepts a proposal, and operate alongside any individual agreement signed between the parties. Where a signed agreement says otherwise, that agreement prevails.
As agreed with each client, Apolo may handle: setup and operation of advertising campaigns on third-party platforms, primarily Meta; performance analysis and reporting; technical audits of accounts, pixels and access; strategic advice on campaigns, offer and targeting; and implementation of automation or AI solutions where within the agreed scope. The specific scope of each engagement is defined in writing beforehand. Anything not agreed is not included.
Advertising spend is paid by the client directly to the platform, using their own payment method on their own account. Apolo does not collect, advance, intermediate or invoice that spend. Apolo's fees are separate and agreed in writing in advance.
Any material change to spend — activating or pausing campaigns, raising budgets, setting or removing caps — requires the client's written authorisation. Technical access to an account does not constitute authorisation to spend from it.
The client agrees to: grant and maintain the necessary access; own or be authorised to operate their accounts, pages and profiles; hold the rights to all content published, including images, text, music, trademarks and the likeness rights of anyone appearing; comply with each platform's advertising policies and applicable law; keep their own legal and privacy notices current; provide accurate information about their business; and respond within reasonable timeframes when a decision of theirs blocks the work.
All advertising accounts, pages, pixels, audiences and data belong to the client, without exception, even where Apolo was involved in creating or configuring them. On termination Apolo retains no assets and revokes its own access. The client keeps their accounts, history and accumulated learning in full.
Apolo treats all business information it accesses as confidential. Information is never combined across clients. Each account is operated with separate technical credentials scoped to that client's assets only — this is how the access is built, not merely a promise.
Where Apolo processes personal data on a client's behalf, it acts as processor and the client as controller. Details are in the Privacy Policy. For clients established in the EEA, the relationship is supplemented by a data processing agreement under Article 28 GDPR.
WhatsApp assistants. Where the service includes a WhatsApp assistant answering the client's contacts: the client is responsible for the information it gives (prices, conditions, hours, availability), which Apolo loads as provided and updates on request; replies are automated and may contain mistakes, binding terms are those the business confirms, and the person can always ask for a human; the client must disclose the assistant in its own privacy notice; conversations are kept for at most 12 months after the last message, and on termination Apolo hands the client a copy on request and deletes the conversations within 30 days.
Apolo is responsible for the diligence with which the service is delivered, not for the commercial result obtained. To the extent permitted by applicable law, Apolo's total liability is limited to the fees actually collected from the client in the three months preceding the event giving rise to the claim. No liability is accepted for lost profits, lost opportunities or indirect damages. These limitations do not apply in cases of wilful misconduct or gross negligence, and do not affect rights that the law treats as non-waivable.
Either party may terminate with fifteen days' written notice, unless another period has been agreed. On termination Apolo delivers outstanding reports, revokes its access and deletes the client's technical credentials. Active campaigns remain under the client's control. Fees accrued to that date are payable.
These terms may be updated. The version in force is always the one published at this address, dated in the header. Material changes are communicated to active clients by email and do not apply retroactively to work already agreed.
These terms are governed by Mexican law. For clients established elsewhere, this does not affect rights their own law treats as non-waivable, particularly in data protection and consumer matters. The parties will attempt to resolve any dispute in good faith before escalating.
